Terms and Conditions

General Terms and Conditions (T&C) of Manu Tour Cusco (MTC)

Thank you for your interest and for placing your trust in us. The following general terms and conditions apply to all services provided by Manu Tour Cusco (hereinafter referred to as MTC).


1. Conclusion of the Contract

1.1 Registration: The confirmation of a booking made in writing, by phone, electronically (online), or in person creates a contract between the client and MTC. This contract is governed by these T&C. At the latest, upon payment of the invoice (or deposit), the client accepts the receipt of these T&C and agrees to their content. The client is responsible for providing accurate personal information (name and date of birth according to passport details) to MTC. It is also the client’s responsibility to verify that the information on the invoice/confirmation is complete and correct. Any inaccuracies must be reported immediately to MTC. The client will be responsible for any costs arising from failure to report such inaccuracies.

1.2 Services from Other Providers: Services not arranged or provided by MTC are governed by the terms and conditions of the respective transportation companies and other service providers, which MTC will provide to the client before the contract is concluded.


2. Payment Terms and Prices

2.1 Payment Terms: Payment is made upon receiving the invoice/confirmation according to the information stated on it. Unless otherwise indicated in the invoice/confirmation, the final payment is due the day before departure.

2.2 Price Changes: MTC may change the price in the following cases:

  • Price changes by transport companies and/or other providers.
  • New or increased taxes or public charges (e.g., VAT, security fees, etc.).
  • Obvious printing or publication errors.

3. Validity of the Reserved Services

Reserved services are valid only on the dates indicated in the invoice/confirmation.


4. Changes to Reservations

Changes to bookings must be requested in writing by the client.


5. Cancellation Policy

5.1 General Provisions: For cancellations before departure, a management fee of at least USD 20 per person and service will be charged, in addition to the cancellation fees mentioned below.

5.2 If you need to cancel the tour for any reason:

  • Before 62 days, we will refund 100% of the money.
  • Before 31 days, we will refund 50% of the money.
  • After 7 days, the refund will be 10%.
  • Flexibility to postpone the tour date.

5.3 Any bank charges or other fees are non-refundable.

5.4 If the tour cannot start due to health reasons, it can be postponed to a later date. In this case, no cancellation fees will be charged.

5.5 If the tour needs to be canceled due to force majeure, MTC will not refund the deposit. Instead, MTC will issue a voucher for the amount of the deposit, which can be used for a tour at any later date.

5.6 Early Return/Trip Interruption: If the client interrupts the trip or changes the agreed-upon services during the trip, the client is not entitled to a refund. Any additional costs incurred due to trip interruption or changes in services will be the responsibility of the client.


6. Travel Insurance

It is strongly recommended that clients purchase travel insurance (for cancellation costs and travel incidents). By choosing not to acquire travel insurance, the client confirms they have sufficient private insurance coverage. The client ensures they have adequate insurance for accidents and illnesses abroad. Important: MTC recommends that clients read the General Terms and Conditions of the Insurance before departure.


7. Passport, Visa, Vaccinations

The client is responsible for complying with the individual requirements for passports, visas, customs, currency, and vaccinations, as well as obtaining the necessary documents.


8. Complaints

If the client has reason to file a complaint during the trip, it must be presented immediately to the tour guide or the relevant service provider (e.g., hotel). This generally allows for corrective actions to be taken on-site.

8.1 MTC is not responsible if the breach or poor performance of the contract is due to:

  • Lack of action by the client.
  • Low sighting of wildlife. We are in the jungle, and we observe animals in their natural environment. We never know in advance which animals we may encounter.
  • Force majeure or an event that MTC or a service provider could not have foreseen or avoided, despite exercising due diligence. Therefore, MTC is not responsible for changes to an itinerary caused by strikes, social unrest, weather conditions, landslides, swollen rivers, decisions made by authorities, delays by third parties, etc.

In the event of force majeure, MTC reserves the right to change, postpone, or even cancel trips.


9. Data Privacy

9.1 Your Data: MTC requires various personal details from you and the members of your group (such as name, surname, date of birth, email address, etc.) for the proper processing of the contract. MTC will only use personal data to carry out the reserved services. The data will not be shared with third parties or used in any other way.

9.2 Transfer to Service Providers and Authorities: MTC will only send your data when necessary for processing the contract with the service providers.

9.3 Exercise of Rights: MTC reserves the right to disclose your data to authorities and third parties in defense of MTC’s legitimate interests. This also applies in cases of suspected criminal activity.
